Compulsory Purchase Order
What is a Compulsory Purchase Order?
A Compulsory Purchase Order (CPO) is the name of a notice received by a landowner stating that their land or property is going to be compulsorily purchased by a State Agency (eg. Local Authority or National Roads Authority). This happens when the State needs to purchase lands or property in order to develop or upgrade roads and infrastructure, erect ESB lines, lay gas pipe lines, etc. The new NAMA legislation also allows for the compulsory purchase of lands and property.
What Can I Do?
A CPO can give rise to many stresses and difficulties. As a land owner you may have questions like ‘Do I have to sell?’, ‘Is the price being offered fair?’ and ‘Are there any other options open to me?’ If you are served with a Compulsory Purchase Order, you have the right to object, negotiate, refer to property arbitrators and have your objections heard. In certain cases a Judicial Review of the decision may be required, and the decision may be reversed.
Compensation
If your house and/or land are the subject of a Compulsory Purchase Order, then you are eligible for compensation. This should be paid based on the market value of your property, and should leave you in a similar position to where you were before your property was acquired.

A Compulsory Purchase Order has been made for the purpose of building the new M11 motorway between Gorey and Oilgate. Notices to treat (i.e. offers to negotiate a compensation package) have now been issued to affected landowners.
